Washington, DC - Civil Rights Class Action

         

        We successfully represented a class of hearing impaired individuals who filed a federal class action lawsuit against two national movie theater chains.  We overcame two federal court decisions that held that closed captioning was not required and obtained a settlement that will provide the Washington, DC area with more closed captioning of movies than any other city in the world.  We also obtained payment of $260,000 in attorneys' fees and expenses.  Both the Court's opinion and a writer for The Harvard Law Review described the firm's success as a "historic settlement." 

 

Washington, DC - Legal Malpractice

 

      We obtained a $375,000 settlement on behalf of a woman who retained an attorney to file a medical malpractice claim on behalf of her late husband's estate.  The late husband was in poor health from other illnesses and the issues of malpractice and the cause of his injuries were strongly contested.  Nevertheless, after extensive negotiations over the medical facts of the case, and retention of a medical expert, we were able to obtain the settlement prior to filing suit.

 

 Washington, DC - Wrongful Death/Excessive Use of Force by Police

       

        We represented two men who were shot by an off duty police officer.  One of the men died and the other was seriously injured.  We filed suit in federal court alleging excessive use of force.  Despite our clients' use of both alcohol and cocaine almost immediately before the incident, we successfully argued that their conduct did not justify the use of lethal force against them.  As a result, we were able to obtain a settlement in excess of $300,000.

 

Washington, DC - Medical Malpractice

 

     We represented a man whose primary care physician failed to properly diagnose a benign rectal tumor.  The responsible doctor denied liability and argued that our client's injuries and treatment were not caused by any negligence on his part.  However, after filing suit and conducting extensive discovery, we were able to obtain a $210,000 settlement prior to trial.

 

Prince George's County, MD - Product Liability

 

       We represented a client whose artificial prosthesis was defective and had to be replaced.  Prior to filing suit, we met with representatives of the manufacturer and were able to negotiate a settlement whereby the manufacturer agreed to pay all of our client's outstanding medical bills and liens, reimburse our client for all of her out of pocket expenses, pay our client $175,000 for her pain and suffering, and pay for an additional 6 months of medical care.

 

Washington, DC - Medical Malpractice

 

       We filed suit and obtained an $180,000 arbitration award for a client who was already suffering from spondolysis and degenerative disc disease when he was injured in an automobile collision.  The negligent driver retained an orthopedic surgeon to testify that the automobile accident did not injure our client any further, but we were successful in persuading the arbitrator that our client's injuries were a direct result of the accident.

 

Arlington, Virginia - Product Liability

       

        We obtained a $230,000 settlement for an airline worker whose hand was crushed by a conveyor belt while he loaded luggage at Reagan National Airport.  The conveyor belt involved had been used nationally for several years and there were no previous reported injuries or complaints regarding it.  Nevertheless, we filed suit alleging that the defective design of the conveyor belt caused our client's injuries.  After extensive discovery and mediation, the manufacturer agreed to settle the case.

 

Howard County, MD -Automobile Accident

         

        We obtained an $180,000 settlement for a woman who was seriously injured when the car in which she was a passenger went off the road while avoiding another vehicle.  Both drivers claimed that the other driver was at fault and refused to make any settlement offer.  However, after conducting depositions of both drivers, we persuaded the insurance companies for both drivers that they each had potential liability.  They then both made significant settlement offers, thereby fairly compensating our client and resolving the case.

 

Montgomery County, Maryland - Product Liability

         

        We obtained a $95,000 settlement for a man who cut his fingers while using a saw.  We filed suit alleging a defective design of the saw and obtained the settlement after successfully defeating the manufacturer's motion to dismiss the case due to our client's own negligence.

 

Charles County, Maryland - Assault

         

        We obtained a $75,000 settlement against a cellular phone store as a result of an assault by a store employee.  Our client entered the store as a customer, but lost his temper due to poor service.  As he attempted to leave the store, he struck a display counter in anger.  A store employee physically attacked him and then chased him as he left the store.  We settled the case even though our client pled guilty to resisting arrest after the incident.

 

Alexandria, VA - Wrongful Death

         

        We obtained a $125,000 settlement on behalf of the estate of an elderly man who was found dead in the middle of a roadway in North Carolina.  The responsible driver claimed that our client was already dead when his vehicle drove over him.  There were no other witnesses, but our investigation of the scene and interviews with the reporting police officers uncovered enough inconsistencies with the driver's story to force his insurance company to settle the case.

 

Arlington County, Virginia - Automobile Accident

         

        We obtained a $50,000 settlement on behalf of a woman who suffered a slight bulging disc as a result of an automobile accident.  Our client had back injuries before the accident due to her job, which consisted of manual labor, and the negligent driver's attorneys argued that her injuries and treatment were not related to the accident.  Nevertheless, after extensive litigation, we persuaded the insurance company and attorney to the contrary and obtained the settlement.

 

Washington, DC - School Negligence

         

        We represented an 8 year old girl who was hit in the nose by her teacher, causing her a bloody nose.  The teacher claimed that the conduct was accidental.  We obtained a settlement of $37,500 for the child, in addition to a full waiver of the applicable Medicaid lien.
